CENTRALITY OF THE CONSTITUTION TO OUR PUBLIC DISCOURSE

Lawmakers and citizens no longer consider simply whether a given bill or policy proposal is a good idea but whether it is constitutional. That's a healthy development. For far too long, even in those rare moments when politicians were faced with constitutional concerns, they've had the attitude Nancy Pelosi did when asked about the authority for Obamacare's individual mandate: "Are you serious?" Because, of course, constitutional arguments are the last refuge of the scoundrel who has no good policy arguments to make or political power to levy.

And so it's a good thing that citizens are taking their founding document seriously. After all, the Constitution is the font of all government power. Its carefully crafted structural provisions that we learned about in grade school, such as the separation of powers and checks and balances, are not merely an application of political theory.

Eurokleptocrats do not respect Lisbon Treaty, the constitution of Fourth Reich. Greece, the most corrupt country in Occident, has become a kangaroo valley, violating basic human rights and Article 2 of the Lisbon Treaty, but nobody gives a damn. I cannot understand why the European Commission tolerates political persecution and freakish Kangaroo Justice within the borders of the European Union and cannot refer the Greek government to the Court of Justice of the European Union. I cannot understand why the European Commission cannot protect Greeks from appalling violations of Article 2 of the Lisbon Treaty by the Greek government. Anthony Kennedy points out federalism is more than an exercise in setting the boundary between different institutions of government for their own integrity. By denying any one government complete jurisdiction over all the concerns of public life, federalism protects the liberty of the individual from arbitrary power. If the federal government acts outside the scope of its delegated and carefully enumerated powers, then it's no better than an armed mob.

Graecokleptocrats use the Lisbon Treaty as toilet paper! The freakish government of Greece uses charge stacking to persecute dissident bloggers. Charge stacking is the ability to charge a large number of overlapping crimes for a single course of conduct. Combining crimes enables prosecutors to get convictions in cases where there is no misconduct at all. By stacking enough charges, including treason, Greek prosecutors jack up the threat value of a trial against a dissident blogger, even if the government's case is very weak. Charge stacking is terror. The disgusting government of Greece cannot terrorize the Greek people.

Shapiro asserts the Obama administration and its allies in Congress have perpetrated more than their share of such mob-like actions. Prevalent is the individual mandate, the requirement that every American purchase health insurance, on penalty of civil fine. The individual mandate is unprecedented and exceeds Congress's power to regulate interstate commerce. If it is allowed to stand, Congress will be able to impose any kind of economic mandate as part of any kind of national regulatory scheme. Fortunately, the Supreme Court has a chance to strike this down during its current term.

Persecuting dissident bloggers, the outlaw government of Greece violates Article 2 of the Lisbon Treaty, which states the European Union is founded on the values of respect for human dignity, freedom, democracy, equality, the rule of law, and respect for human rights. These values are common to the Member States in a society in which pluralism, nondiscrimination, tolerance, and justice prevail.

Greece, the bully of blogosphere, has crossed the Rubicon against civility, terrorizing and robbing dissident bloggers. Greece also violates Article 10 of the European Convention on Human Rights, which states that everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.
